Payments & Deposits

Payment terms will be confirmed with the client before work begins. Projects priced at $50.00 or less require full payment upfront. Projects over $50.00 generally require a 50% deposit before work begins, with the remaining 50% due upon completion and before final, unwatermarked files or deliverables are provided.

For custom projects, large projects, or projects with a unique scope, ThrottlePress may use a different payment structure. Any changes to the standard payment terms will be discussed and agreed upon before payment is collected or work begins.

ThrottlePress currently accepts payment through Venmo, Cash App, and PayPal.

Cancellations & Refunds

Deposits and upfront payments become non-refundable once work on a project has begun. If a client chooses to cancel a project after work has started, ThrottlePress will retain any deposit or payment already earned for work performed up to that point. Any remaining unpaid balance will not be charged unless otherwise agreed upon.

If ThrottlePress is unable to complete a project due to circumstances within ThrottlePress’s control, the client will receive a full refund of all payments made for that project. This does not apply when completion is prevented by the client, including failure to provide required necessary approvals, requested cancellation, or other circumstances outside of ThrottlePress’s reasonable control.

Completed projects and final deliverables are non-refundable once they have been approved and delivered to the client.

For photography or other trackside services, cancellations made before ThrottlePress begins travel to the event are eligible for a refund of the deposit. Once travel has begun or ThrottlePress has arrived at the event, deposits are non-refundable due to travel, admission, credential, and preparation costs.

Race cancellations, weather delays, shortened events, crashes, mechanical failures, DNFs, or other circumstances outside of ThrottlePress’s control do not guarantee a refund once coverage has begun. ThrottlePress will make a reasonable effort to provide as much of the agreed-upon coverage as circumstances allow.

Client Communication & Project Delays

Clients are generally expected to respond to ThrottlePress requests for feedback, approvals, information, or required materials within five (5) business days. If a response is not received within this period, the project may be placed on hold, and any previously estimated completion or delivery date may be adjusted.

ThrottlePress will make a reasonable attempt to follow up with the client before closing an inactive project. If the client does not respond for thirty (30) calendar days following ThrottlePress’s most recent request for information, feedback, approval, or materials, the project may be considered abandoned and closed.

Payments already earned for work completed before the project was placed on hold or closed are non-refundable. If the client later wishes to resume an abandoned project, ThrottlePress may require a new project agreement, updated pricing, and/or an additional payment before work resumes.

Delays caused by a client’s failure to respond, provide required materials, or provide necessary approvals will not be considered a failure by ThrottlePress to complete the project.

Revisions & Client Approval

Each ThrottlePress service includes the number of revision rounds listed in the service description or agreed upon before work begins. A revision round may include multiple reasonable changes submitted together by the client.

Additional revisions beyond the included amount may require an additional fee. The cost of additional revisions will be communicated to the client before additional work is performed.

Revisions must remain within the originally agreed-upon project scope. Requests that substantially change the original concept, direction, or scope of the project may be treated as additional work and may require updated pricing.

ThrottlePress may provide watermarked or otherwise marked previews for client review. Final, unwatermarked files or deliverables will be provided after the project is approved and any remaining balance has been paid.

Once a client gives final approval any changes requested afterward may be considered a new revision or additional project and may require an additional fee.

Ownership & Usage Rights

Unless otherwise agreed in writing, all concepts, drafts, previews, and other creative work produced by ThrottlePress remain the property of ThrottlePress until the project has been completed and all required payments have been received.

Upon full payment, the client receives the ownership or usage rights specified for the applicable service or project.

Concepts or work that are rejected, cancelled, or associated with an abandoned project remain the property of ThrottlePress. ThrottlePress may modify, reuse, display, license, or resell such unused work, provided that client-provided materials are removed unless ThrottlePress has permission to use them.

Client-provided materials remain the property of their respective owners and are not transferred to ThrottlePress.

Turnaround Times & Delivery

Project turnaround times vary depending on the service, project scope, current workload, client response times, and other project requirements. Any estimated completion or delivery date provided by ThrottlePress is an estimate unless a specific deadline has been agreed upon in writing before work begins.

Turnaround time begins once all required payment or deposit, project information, materials, and instructions have been received.

Client-requested revisions, changes in project scope, delayed responses, or delayed delivery of required materials may extend the estimated completion date.

If a client requires completion by a specific date, that deadline must be communicated and accepted by ThrottlePress before work begins. ThrottlePress does not guarantee deadlines that were not previously agreed upon.

Final files or deliverables will be provided after client approval and receipt of any remaining balance. Delivery methods and file formats may vary depending on the service.

Client-Provided Materials & Permissions

Clients are responsible for ensuring that they have the necessary rights, licenses, or permissions to use any logos, photographs, videos, graphics, trademarks, text, or other materials they provide to ThrottlePress for use in a project.

By providing materials to ThrottlePress, the client grants ThrottlePress permission to use, reproduce, edit, modify, and incorporate those materials as necessary to complete the agreed-upon project.

ThrottlePress is not responsible for copyright, trademark, licensing, or other intellectual property disputes resulting from materials supplied by the client. The client is responsible for obtaining any permissions required for their use.

ThrottlePress reserves the right to refuse to use client-provided materials if ThrottlePress reasonably believes their use may violate applicable law, intellectual property rights, or the rights of another person or organization.

Portfolio & Promotional Use

Unless otherwise agreed upon in writing, ThrottlePress may display completed work created for a client in its portfolio, website, social media accounts, advertisements, promotional materials, and other examples of ThrottlePress’s services.

This may include the client’s name, team name, vehicle, publicly available branding, and the final work created by ThrottlePress when reasonably necessary to showcase the project.

ThrottlePress will not intentionally disclose confidential information, private communications, unpublished business information, or other materials identified by the client as confidential.

Clients who require a project to remain private or who do not want completed work used for promotional purposes must notify ThrottlePress in writing before work begins. Any agreed-upon confidentiality or promotional restrictions will be confirmed in writing.

Photography & Trackside Services

ThrottlePress will make a reasonable effort to provide the photography, video, and other trackside coverage included in the client’s selected service or agreed-upon project scope.

Specific photographs, moments, locations, angles, subjects, or quantities beyond those expressly included in the service are not guaranteed. Motorsports events are unpredictable, and ThrottlePress cannot guarantee coverage of moments that are missed or made inaccessible due to crashes, mechanical failures, DNFs, schedule changes, weather, track conditions, restricted access, credential limitations, event officials, safety requirements, or other circumstances outside of ThrottlePress’s reasonable control.

Clients are responsible for informing ThrottlePress of relevant schedules, vehicle numbers, driver names, classes, appearances, locations, or other information reasonably necessary to provide the requested coverage.

ThrottlePress will comply with applicable track, series, sanctioning body, and event rules while providing coverage. ThrottlePress will not enter restricted areas, violate safety requirements, or disregard instructions from event personnel in order to obtain requested content.

Unless otherwise agreed upon, admission, credential, travel, lodging, or other event-related expenses that are not included in the listed service price will be discussed with and approved by the client before they are incurred.

Web Design & Maintenance

ThrottlePress may provide website design, setup, redesign, and maintenance services based on the scope agreed upon with the client before work begins.

Clients are responsible for providing accurate information, text, images, logos, account access, and other materials reasonably necessary to complete the website. Delays in providing required materials or approvals may extend the project’s estimated completion date.

Unless otherwise agreed upon, clients are responsible for costs associated with third-party services including domain registration, website hosting, platform subscriptions, premium plugins, applications, email services, or other external services required for the website.

ThrottlePress does not guarantee uninterrupted availability or performance of third-party platforms, hosting providers, domain registrars, plugins, integrations, or other services outside of ThrottlePress’s reasonable control.

Upon completion of the project and receipt of full payment, ownership or administrative control of the completed website will be transferred or provided to the client as agreed upon for the project. The client is responsible for maintaining their own account credentials, subscriptions, billing information, and domain ownership after transfer unless an ongoing maintenance agreement has been established with ThrottlePress.

Website maintenance, updates, troubleshooting, or modifications requested after the original project has been completed are not included unless specifically stated in the original services or covered by a separate maintenance agreement.

ThrottlePress is not responsible for changes, errors, outages, security issues, or other problems caused by the client, third parties, platform updates, plugins, integrations, or modifications made after the website has been delivered or transferred.

Limitation of Liability

ThrottlePress will make a reasonable effort to provide services accurately, professionally, and according to the agreed-upon project scope. However, ThrottlePress does not guarantee specific business, financial, sponsorship, employment, racing, marketing, social media, website traffic, or other results from the use of its services.

ThrottlePress is not responsible for indirect, incidental, or consequential losses resulting from the use or inability to use completed work or services, including lost revenue, lost sponsorship opportunities, lost business opportunities, or similar losses, to the extent permitted by applicable law.

To the extent permitted by applicable law, ThrottlePress’s total liability, arising from a project or service will not exceed the amount actually paid by the client to ThrottlePress for the specific project or service giving rise to the claim.

Nothing in these terms is intended to limit or exclude liability that cannot legally be limited or excluded under applicable law.

Third-Party Services & Platforms

ThrottlePress may use or recommend third-party platforms, software, services, websites, payment providers, printing companies, hosting providers, social media platforms, or other outside services while completing client work.

ThrottlePress does not control these third parties and is not responsible for their availability, pricing changes, policies, outages, account restrictions, service changes, data loss, errors, or other actions outside of ThrottlePress’s reasonable control.

Any fees charged directly by a third party are the client’s responsibility unless otherwise agreed upon in writing.

Right to Refuse or Discontinue Service

ThrottlePress reserves the right to refuse a project before work begins.

ThrottlePress may also suspend or discontinue an active project if a client engages in harassment, threats, fraudulent activity, illegal activity, repeated failure to communicate, failure to make required payments, requests that violate appliciable law or third-party rights, or other conduct that makes continued completion of the project unreasonable.

If ThrottlePress discontinues a project for reasons caused by the client’s actions or failure to meet their responsibilities, refunds will be handed out according to the cancellation and refund terms above.

If ThrottlePress independently chooses to discontinue a project for reasons not caused by the client and is unable to complete the agreed-upon work, the client will receive a refund of payments made for work that will not be completed.

Changes to Services, Pricing & Policies

ThrottlePress may update its services, pricing, policies, and terms from time to time. Changes to publicly listed prices or terms will not retroactively change the agreed-upon price or terms of an active project unless both ThrottlePress and the client agree to the change in writing.

The version of these Policies & Terms in effect when a project is confirmed will generally apply to that project.

Acceptance of Terms

By submitting payment or otherwise confirming that ThrottlePress should begin a project, the client acknowledges that they have had the opportunity to review and agree to the applicable project details and these Policies & Terms.

Any separate written agreement between ThrottlePress and the client regarding a specific project may supplement these terms. If a specific written project agreement conflicts with these general terms, the specifically agreed-upon project terms will control for that project.
